SAN DIEGO (AP) — A Mexican man is charged with assaulting a Border Patrol agent near San Diego in a scuffle that some activists say shows the agent used excessive force.
The federal complaint says Vulfrano Merino punched the agent in the chest and repeatedly tried to hit him again. He allegedly continued to resist after the agent shot him in the back with a stun gun.
Merino was pulled over on Monday near Temecula. The driver of the van he was in captured part of scuffle on his phone and shared the video with KGTV (http://bit.ly/1dA1mKS ). The Border Patrol went to the man's home hours later and seized the video.
Merino is also charged with a felony count of re-entering the country after being deported. His attorney, Victor Pippins, declined to comment.
